These Terms of Service ("Terms") govern your access to and use of the 5 rider app and two-wheeler rental service (the "Service"), operated by 5 ("we", "us", "our"). By creating an account, completing identity verification, or booking a vehicle through the Service, you ("you", "Rider") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age and hold a valid driving licence authorizing you to operate a two-wheeler motor vehicle to use the Service. By registering, you represent that you meet these requirements and that all information you provide — including your name, phone number, and identity documents — is accurate and current.
2. Account Registration & Verification
Access to the Service requires registering an account and verifying your phone number via a one-time password (OTP). You must also complete identity verification (KYC) by submitting a government-issued photo ID (Aadhaar), a valid driving licence, and a selfie photograph, as described in our Privacy Policy. We may decline to activate, or may suspend, any account where submitted documents cannot be verified, appear altered, or do not match. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
3. The Service
5 rents electric two-wheelers to verified riders on a rental-plan basis. Vehicle pickup and return currently take place at a designated hub location — the Service does not offer doorstep delivery or pickup unless expressly stated at the time of booking. Available vehicles, plans, and pricing are shown in the app and may vary by location and over time.
4. Booking & Reservation
When you request a vehicle, it is reserved on your behalf pending payment confirmation. A request remains pending until our operations team either confirms your payment (at which point your booking is activated) or rejects it (at which point the reservation is released and the vehicle becomes available to other riders). Submitting a booking request does not guarantee that a vehicle will ultimately be allocated to you.
5. Payments
The Service does not process card or bank payments within the app. Payment for your rental plan, security deposit, and any onboarding charges is made outside the app — via a UPI QR code or payment link shared with you — and is confirmed manually by our operations team once received. Your booking is not active, and the vehicle is not released to you, until payment has been confirmed. Rental amounts, plan duration, and any onboarding charges are shown to you at the time of booking and are recorded against your booking so that your rental terms remain fixed even if pricing changes later.
6. Security Deposit
Your rental may require a refundable security deposit. The deposit is held against damage to the vehicle, unpaid dues, traffic challans attributable to your rental, or other amounts you owe under these Terms, and is refunded to you — less any such deductions — on termination of your rental and successful return of the vehicle. If deductions exceed your deposit, your account balance may reflect a due amount rather than a refund; it will never be shown as negative. Deposit refunds are processed manually by our operations team and may take time to complete.
7. Rental Period, Renewal & Non-Payment
Your rental runs for the plan duration you booked. Continuing to use the vehicle beyond that period requires renewing your plan and completing payment for the renewed period in the same manner as your original booking. If a renewal payment is not completed, we may treat your rental as overdue, and reserve the right to recover the vehicle, suspend your account, and pursue any dues owed, including via your security deposit.
8. Vehicle Use & Rider Responsibilities
- Only you, the registered Rider, may operate the vehicle — you may not lend, sub-rent, or transfer possession of the vehicle to any other person.
- You must hold a valid driving licence and comply with all applicable traffic laws, signals, and speed limits at all times while operating the vehicle.
- You must wear a helmet and any other safety equipment required by law, and must not operate the vehicle under the influence of alcohol or any impairing substance.
- You must not use the vehicle for racing, towing, off-road use, carrying passengers or loads beyond its rated capacity, or any illegal purpose.
- You must not modify, disassemble, or tamper with the vehicle, its battery, or any fitted equipment.
- You are responsible for charging the vehicle's battery as needed and for taking reasonable care of the vehicle for the duration of your rental, as you would your own property.
- You must promptly report any accident, theft, breakdown, or damage to 5 support.
9. Vehicle Condition, Inspection & Damage
Every returned vehicle is inspected before it is made available to another rider. If damage beyond normal wear and tear is found, or if the vehicle is returned in a condition requiring repair, the assessed cost may be charged to your account as dues, deducted from your security deposit, or both. Any traffic challan, fine, or toll charge issued in respect of the vehicle during your rental period is your responsibility and may similarly be charged to your account.
10. Return of the Vehicle
You must return the vehicle to the designated hub at or before the end of your rental period (or upon termination of your rental), in substantially the condition it was provided, ordinary wear and tear excepted. Failure to return the vehicle when due may be treated as unauthorized use and may result in additional charges, suspension of your account, and recovery of the vehicle.
11. Cancellations & Refunds
You may cancel a pending booking request at any time before payment is confirmed. Once a booking has been activated, cancellation and any associated refund of rental fees are handled by our operations team on a case-by-case basis. Security deposit refunds are governed by Section 6 above.
12. Prohibited Uses
You agree not to:
- use the vehicle to commit, facilitate, or conceal any unlawful act;
- misrepresent your identity or provide false, forged, or another person's documents during KYC;
- circumvent, disable, or interfere with any safety, tracking, or security feature of the vehicle;
- use the Service in any way that could damage, disable, or impair it, or interfere with any other rider's use of it; or
- attempt to gain unauthorized access to any account, system, or data related to the Service.
13. Suspension & Termination
We may suspend or terminate your account or any active rental, with or without notice, if you breach these Terms, provide false information, fail to pay amounts due, misuse the vehicle, or if we reasonably believe continuing the rental poses a risk to you, others, or the vehicle. You may terminate your rental at any time by returning the vehicle to the designated hub and settling any outstanding dues.
14. Disclaimers
The Service and the vehicles provided under it are made available on an "as is" and "as available" basis. While we take reasonable care to keep vehicles roadworthy, we do not guarantee uninterrupted availability of any specific vehicle, plan, or feature of the app. You are responsible for satisfying yourself, before riding, that the vehicle is in a condition you consider safe to operate, and for reporting any concern to us before use.
15. Limitation of Liability
To the fullest extent permitted by law, 5 will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Service or a rented vehicle, including loss of income or personal injury arising from your own operation of the vehicle in breach of applicable traffic law or these Terms. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded.
16. Indemnity
You agree to indemnify and hold 5 harmless from any claim, loss, fine, or expense arising from your breach of these Terms, your misuse of a rented vehicle, or your violation of any applicable law while the vehicle is in your possession.
17. Force Majeure
We will not be liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including natural disasters, government action, civil unrest, or disruption to power, network, or payment infrastructure.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service or applicable law. If we make material changes, we will take reasonable steps to notify you through the app. Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts where 5 is registered.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
